Hemp & CBD in Alcohol Beverages

5/19/2019 – As discussed in an earlier post the Food and Drug Administration (FDA) maintains that they have authority to regulate CBD in food and beverages, including alcoholic beverages, under the Federal Food, Drug, and Cosmetic Act (FD&C Act).

The Alcohol and Tobacco Tax and Trade Bureau (TTB) has adopted a similar position on the use of CBD and hemp in alcohol beverages. TTB has stated that ingredients from industrial hemp, including CBD, will not be permitted in alcohol, in accordance with FDA’s guidelines. In a recent statement, TTB said that any applications for formulas that contain ingredients from hemp will be returned. The exceptions to this are ingredients from hemp seeds or hemp seed oil, which may be used.
